TERMS OF USE

Important: by using EriLaws resources, you are agreeing to be bound by the following terms:

ERILAWS LICENSE AGREEMENT

Please read this license agreement (“license”) carefully before using EriLaws facility and services. By using EriLaws services or downloading an item from EriLaws database, as applicable, you are agreeing to be bound by the terms of this license. If you do not agree to the terms of this license, do not use EriLaws facility or download from EriLaws services.

1.     General

(a)   EriLaws and its contents (including laws, legislations, regulations, court decisions, ordinances, content and any data that came with your subscription to EriLaws, as may be updated or replaced by feature enhancements, are licensed, not sold, to you by EriLaws, for use under the terms of this License. EriLaws retains ownership of the EriLaws facility and all its contents and all rights not expressly granted to you.

(b)   EriLaws, at its discretion, may make available future database updates. EriLaws may enhance, add to, withdraw, or change the online service or its content at any time without notice. Unless EriLaws update is accompanied by a separate license in which case the terms of that license will govern, these terms of use shall govern all activities of users.

(c)   EriLaws reserves the right to investigate potential violations of these Terms of Use and to take actions its deems fit. 

(d)   These Terms of Use are governed by and construed in accordance with the laws of the State of Massachusetts regardless of the law that might apply under applicable principles of conflict of laws. You agree that any action out of or relating to these terms or the Web Site or its content shall be settled by arbitration chosen by EriLaws in the state of Massachusetts only. Should this found to be incompatible any action out of or relating to these terms should be filed only in state or federal courts located in Massachusetts. 

(e)   These terms do not exclude the application of additional terms of use that may be included in the context of particular use or service by EriLaws. 

(f)    These Terms of Use and other terms that may be included in the context of particular use or service by EriLaws constitute the entire agreement with respect to access to and use of this Web Site and its contents. Charges and payment terms may be changed upon notice to you. You may terminate this subscription agreement upon written notice to EriLaws if new changes are not acceptable to you. Notice for termination must be provided within 60 days of change of terms. EriLaws reserves the right to charge for resources and services provided by EriLaws before you submitted notice of termination. Such charges are calculated by prorating annual access fee to months and days. EriLaws reserves the right to change these Terms of Use at any time. Updated versions of the Terms of Use will appear on this Web Site and are effective immediately. Continued use of this Web Site or its contents after any change to the Terms of Use constitutes consent to such changes. 

2.     Permitted License Uses and Restrictions

(a)   Subject to the terms and conditions of this License, you are granted a limited non-exclusive, nontransferable, revocable limited license to use EriLaws facility.

(b)  Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download contents of EriLaws.

(c)   You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, modify, or create derivative works of EriLaws facility or any services provided by the EriLaws facility. 

(d)  You may not use any network monitoring or discovery software to determine the site architecture, or extract information about usage, individual identities or users. 

(e)   You may not use any robot, spider, other automatic software or device, or manual process to monitor or copy the website or its contents without permission. 

(f)   You may not copy, modify, reproduce, republish, distribute, display or transit for commercial, non-profit or public purposes all or part of this website and its content without explicit consent.

(g)   You may not rent, lease, lend, sell, redistribute, or sublicense contents of EriLaws facility. 

(h)  You may not store downloaded materials in archival databases.

(i)    You may not obscure the copyright notices or other notices that exist in downloaded materials.

(j)    You agree to use the EriLaws facility and its services in compliance with all applicable laws of the State of Massachusetts. Use of and access to certain features of the EriLaws facility may require you to apply for a unique user name and password combination. You agree that each EriLaws ID may only be used by the authorized user and may not be shared with or used by any other person, including other authorized users. 

3.     Termination

This License is effective until terminated. Your rights under this License will terminate automatically or otherwise cease to be effective without notice from EriLaws facility if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of EriLaws facility. Nevertheless, your liability for violation of violating terms of licensing use will persist.

4.     Disclaimer and Limitations of Liability

(a)   Content provided in this website is not intended to and does not constitute legal advice and no attorney-client relationship is formed. Contents in this website is not treated confidential. 

(b)  Users assume all liability for any claims, suits or grievances filed against them as a consequence of using EriLaws.

(c)   This Web Site and its contents are provided on and as is, as available basis. EriLaws disclaims all warranties – including warranties of merchantability, fitness for a particular purpose and non-infringement. EriLaws disclaims any responsibility for any loss, injury, claim, liability or damage of any kind resulting from, arising out of or any related to: any errors in or omissions from this Web Site or its contents, any third party website or content directly or indirectly accessed through links in this website, the unavailability of this website or its contents, and the use of any equipment or software in connection with this Web Site or its contents.

(d)  EriLaws shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting from use of this Web Site or its contents. EriLaws shall not be liable for any special, direct, indirect, incidental, punitive or consequential damages of any kind whatsoever in any way due to resulting from or arising in connection with the use of or inability to use this Web Site or its contents. Should this limitation of liability fail or is prohibited, EriLaws sole obligation to its users for damages shall be limited to maximum of $50.00 (fifty US Dollars).

(e)   EriLaws retains the right to enhance, add, withdraw, or otherwise change the contents of its online services, facility and materials.

EriLaws aspires to advance rule of law by providing up to date and reliable access to law. As it is the case with several African states, national laws are not easily accessible. Lack of access to law hinders development of legal education, legal research, advocacy and economic development. EriLaws aims to bridge the information gap by catering legal resources to broad range of audience. EriLaws hopes access to critical resources will advance rule of law and economic growth for both the Eritrean and South Sudanese Societies.
